Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Jason Wong ("we", "us", or "our") governing your use of the Travel Tracker mobile application (the "App").

By creating an account or using the App, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

2. Description of Service

Travel Tracker is a mobile application that allows users to:

• Discover, save, and organize travel destinations and places
• Plan trips and create itineraries
• Rate and add notes to places they've visited
• Collaborate with other users by sharing trips and lists
• Access recommendations for activities and tours through affiliate partners

The App is provided free of charge. We may introduce paid features in the future, which will be clearly disclosed.

3. User Accounts

3.1 Account Creation

To use Travel Tracker, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.2 Account Security

You must:

• Choose a strong password
• Never share your password with anyone
• Keep your contact information up to date

We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Termination

You may delete your account at any time through Settings → Delete Account. Upon deletion:

• All your data is permanently deleted immediately
• This action cannot be undone
• You will lose access to all trips, notes, and saved places

4. User Content and Conduct

4.1 Your Content

"User Content" means any information, text, notes, ratings, trip names, photos, or other materials you upload, post, or share through the App.

You retain ownership of your User Content. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, display, and transmit your User Content to provide the App service
• Share your User Content with other users when you choose to collaborate or share trips
• Use anonymized, aggregated data derived from User Content for analytics and app improvement

This license ends when you delete your User Content or account, except for:

• Content that has been shared with other users (which may remain visible to them)
• Anonymized, aggregated data that cannot identify you personally

4.2 Shared Content

When you share a trip or list with other users:

• Those users can view the trip, places, and any notes you've added
• If you delete the trip, it will be removed from their accounts
• If you delete your account, your contributions will be anonymized but may remain visible
• You are responsible for the content you choose to share

4.3 Ratings

Your ratings of places are visible to all Travel Tracker users globally to help the community. By submitting ratings, you agree that:

• Ratings are public and cannot be made private
• Ratings should be honest and based on your actual experience
• You will not submit false or misleading ratings

4.4 Prohibited Conduct

You agree NOT to:

• Post illegal, harmful, threatening, abusive, harassing, defamatory, or offensive content
• Impersonate any person or entity
• Post spam, advertising, or promotional content without authorization
• Upload viruses, malware, or any malicious code
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Scrape, crawl, or automatically collect data from the App
• Use the App for any illegal purpose
• Interfere with or disrupt the App's operation
• Submit false ratings or manipulate the rating system
• Violate any applicable laws or regulations

4.5 Content Moderation

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable. We are not obligated to monitor User Content but may do so at our discretion.

5. Third-Party Content and Services

5.1 Google Places Data

The App displays place information (names, addresses, photos, reviews, ratings) from Google Places API. This content:

• Is owned by Google and third-party contributors
• Is subject to Google's terms and conditions
• May be inaccurate, outdated, or incomplete
• We are not responsible for the accuracy or reliability of this data

5.2 Affiliate Links and Commissions

5.3 Links to Third-Party Websites

The App may contain links to third-party websites or services. We do not control or endorse these sites and are not responsible for their content, privacy practices, or terms of service.

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, features, functionality, and code, is owned by Jason Wong and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App or its content (except your own User Content)
• Reverse engineer or attempt to extract the source code
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the App

6.2 Feedback

If you provide us with feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you.

7. Disclaimers and Limitations of Liability

7.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Merchantability, fitness for a particular purpose, and non-infringement
• Accuracy, reliability, or completeness of any content or data
• Uninterrupted, secure, or error-free operation
• Results obtained from using the App

7.2 No Travel Advice

Travel Tracker is a planning and organizational tool. We do not provide:

• Professional travel advice or recommendations
• Safety assessments or warnings about destinations
• Guarantees about the quality, safety, or legality of any place or activity

You are solely responsible for your travel decisions, safety, and compliance with laws and regulations.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• Damages arising from your use or inability to use the App
• Damages resulting from third-party services, affiliate partners, or booking platforms
• Damages resulting from unauthorized access to your account
• Any content, conduct, or errors of other users

OUR TOTAL LIABILITY SHALL NOT EXCEED SGD $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER).

7.4 Indemnification

You agree to indemnify and hold harmless Jason Wong from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

8. Privacy

Your use of the App is also governed by our Privacy Policy, available at www.traveltracker.cc/privacy. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

9. Termination

9.1 Termination by You

You may stop using the App and delete your account at any time.

9.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• Your conduct poses legal liability or risk to us or other users
• We discontinue the App (with reasonable notice)

Upon termination:

• Your right to use the App ends immediately
• We may delete your account and User Content
• Sections 4.1 (license grant), 7 (disclaimers and liability), 9.3 (effects of termination), and 11 (governing law) survive termination

9.3 Effect of Termination

Termination does not affect any rights or obligations that arose before termination.

10. Changes to the App and Terms

10.1 Changes to the App

We may modify, suspend, or discontinue any part of the App at any time without notice. We are not liable for any changes, suspension, or discontinuation.

10.2 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the App and delete your account.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Singapore.

11.3 Informal Resolution

Before filing any legal action, you agree to first contact us at [email protected] to attempt to resolve the dispute informally.

12. General Provisions

12.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the App.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

12.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account. We may assign these Terms to any successor or affiliate.

12.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of the App.
